We Care For Seniors Caregiving

TERMS AND CONDITIONS

Please read these Terms and Conditions ("Terms") carefully before using the services or website of We Care For Seniors Caregiving ("Company," "we," "us," or "our"), located at http://wecareforseniorscaregiving.com/. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

We Care For Seniors Caregiving provides in-home and facility-based caregiving services for seniors in the Huntington Beach, California area and surrounding regions. Our services may include but are not limited to: personal care assistance, companionship, meal preparation, light housekeeping, medication reminders, and transportation assistance.

Specific services, schedules, and care plans will be outlined in a separate Service Agreement between the Company and the client or their authorized representative.

2. Eligibility

By using our website or services, you represent that you are at least 18 years of age and legally authorized to enter into a binding agreement, whether on your own behalf or on behalf of a care recipient.

3. Payments and Fees

  • All service fees are outlined in your individual Service Agreement.
  • Payment is due in accordance with the payment schedule agreed upon at the time of service commencement.
  • Late payments may be subject to a late fee as described in your Service Agreement.
  • We reserve the right to suspend services for non-payment after reasonable notice.

4. Cancellations and Scheduling

  • Cancellations must be made at least 24 hours in advance unless otherwise specified in your Service Agreement.
  • Late cancellations or no-shows may be subject to a cancellation fee.
  • We reserve the right to reschedule or reassign caregivers due to illness, emergencies, or staffing changes, and will make reasonable efforts to provide advance notice.

5. Caregiver Conduct

All caregivers employed or contracted by We Care For Seniors Caregiving are expected to maintain professional standards of conduct, confidentiality, and respect for clients. 6. Client Responsibilities

Clients and their authorized representatives agree to:

  • Provide accurate and complete information about the care recipient's health, needs, and living environment
  • Maintain a safe working environment for caregivers
  • Notify us promptly of any changes in health status or care needs
  • Treat caregivers with respect and dignity
  • Not solicit, hire, or engage any caregiver placed by us privately, outside of our services, for a period of 12 months following the termination of services

7. Limitation of Liability

To the fullest extent permitted by law, We Care For Seniors Caregiving shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you in the three (3) months preceding the claim.

We are not responsible for outcomes resulting from inaccurate information provided by clients or care recipients, or for events beyond our reasonable control.

8. Indemnification

You agree to indemnify, defend, and hold harmless We Care For Seniors Caregiving, its officers, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

9. Confidentiality and HIPAA

We respect the privacy of all clients and care recipients. To the extent applicable, we comply with the Health Insurance Portability and Accountability Act (HIPAA) and California state privacy laws. Any protected health information will be handled in accordance with our Privacy Policy and applicable law.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of We Care For Seniors Caregiving and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Orange County, California.

12. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration in Orange County, California, in accordance with the rules of the American Arbitration Association, before resorting to litigation.

13. Termination of Services

Either party may terminate services upon written notice as specified in the Service Agreement. We reserve the right to terminate services immediately if a client or household poses a safety risk to our caregivers, or if these Terms or the Service Agreement are materially breached.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

15. SMS and Text Messaging

By providing your phone number to We Care For Seniors Caregiving, you agree and acknowledge that we may send text messages to your wireless phone number for any purpose related to your care or inquiries.

Privacy and Data Sharing:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted; however, all other use case categories exclude text messaging originator opt-in data and consent. This opt-in data and consent will not be shared with any third parties.

  • Message Frequency: Message frequency will vary depending on your interactions with us.
  • Opt-Out: You can cancel the SMS service at any time. Simply text "STOP" to the number from which you received the message. Upon sending "STOP," we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
  • Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or contact us directly at Info@WeCareForSeniorsCaregiving.com or +1 (714) 369-2408.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider.
